Question : 


The Law Naming a Mosque with a person's name

Can you name the Mosque with the name of the person who waqf, for example, the Masjid Suciati Saliman, because of the one who waqf Mrs. Suciati Saliman? Please enlighten.

Answer:
Bismillahi Rahmani Raheem

Bismillah was shalatu was salam' ala Rasulillah, wa ba'du,

Allah affirms in the Qur'an that Mosques belong to Allah, so that humans cannot worship other than Him.

Allah says,


وَأَنَّ الْمَسَاجِدَ لِلَّهِ فَلَا تَدْعُوا مَعَ اللَّهِ أَحَدًا



"And [He revealed] that the masjids are for Allah, so do not invoke with Allah anyone. 


According to the commentary of Ibn Abbas radhiyallahu ' anhuma, that what is meant by' Mosques' in the verse above is the Mosque building. Jews and Christians when they enter their house of worship (church or synagogue), they do shirk to Allah. Then Allah commands the Muslims to express worship only to Allah when entering the Mosque.

Next, can you name a Mosque with the name of the person who waqf? For example Abdul Aziz Mosque, or Budiman Mosque, or Suciati Saliman Mosque.

The attribution function of something to the name, can aim to show ownership, can also aim only an identity. When someone is already a waqf, in essence, what he waqf is no longer his property, but the common property of the Muslims, so that they have the same rights to use it.

Because the ownership rights have been moved, the Mosque's association with someone's name will not be understood by the community that the Mosque is still the property of that person.

Imam al-Bukhari made the chapter title in the book of saheeh,


باب هَلْ يُقَالُ مَسْجِدُ بَنِى فُلاَنٍ



Chapter, may you call a Mosque with Bani Fulan? 

(Sahih Bukhari Chapter 41).

Then al-Hafidz Ibn Hajar in his explanation stated that the ulama (almost all scholars), was allowed to name the Mosque with the name of a particular individual. What is forbidden in this case is a Tabi'in cleric, Ibrahim an-Nakha'i.

al-Hafidz Ibn Hajar said,


والجمهور على الجواز والمخالف في ذلك إبراهيم النخعي فيما رواه بن أبي شيبة عنه أنه كان يكره أن يقول مسجد بني فلان ويقول مصلى بني فلان لقوله تعالى وان المساجد لله



The majority of scholars allow naming Mosques with personal names. What is different in this case is Ibrahim an-Nakha'i. As mentioned in the history of Ibn Abi Syaibah, from an-Nakha'i, that he hated someone calling the Banu Fulan Mosque or the Banu Fulan Mushola. Because Allah says (which means) "that all Mosques belong to Allah." (Surat al-Jin: 18)

Furthermore, al-Hafidz strengthened the opinion of jumhur (Majority) Ulama, he said,


وجوابه أن الإضافة في مثل هذا إضافة تمييز لا ملك



The answer to the claim above that the association, in this case, is an association for the identity, not an association for ownership. 

(Fathul Bari, 1/515 - 516).

There are many arguments that show the name of a Mosque with a personal name, including:

[1] Word of the Prophet sallallaahu 'alaihi wa sallam,


صَلَاةٌ فِي مَسْجِدِي هَذَا خَيْرٌ مِنْ أَلْفِ صَلَاةٍ فِيمَا سِوَاهُ إِلَّا الْمَسْجِدَ الْحَرَامَ



Prayers in my Mosque are better than 1000 times prayers in other Mosques, other than the holy Mosque. 

(Narrated by Bukhari 1116 & Muslim 2470)

He called the Nabawi Mosque with "my Mosque", because he was the first to waqf it.

[2] Hadith from Ibn Umar radhiallahu 'anhuma , he told,


أن رسول الله -صلى الله عليه وسلم- سابق بين الخيل التي أضمرت من الحفياء وأمدها ثنية الوداع وسابق بين الخيل التي لم تضمر من الثنية إلى مسجد بني زريق



"The Prophet sallallaahu 'alaihi wa Sallam had participated in a horse race which was deflated from Hafaya' and ended at Tsaniyyatul Wada ', and followed a horse race which was not deflated in its stomach from Tsaniiyah to the Bani Zuraiq Mosque." 

(Narrated by Bukhari 403).

[3] Narrated by Ibn Abi Syaibah, and Zir bin Hubaisy and Rabi 'ibn Khaitsam, they said,


مسجد بني فلان, وأن جابراً قال: "فأتى مسجد معاذ



"Bani Fulan Mosque. That Jabir said, he went to the Mosque of Muadz. "
(Mushannaf Ibn Abi Syaibah, 2/327).



The naming of the 'Bani Zuraiq Mosque', 'Masjid Bani Fulan' or 'Mu'adz Mosque' shows that Sahabah are used to naming their Mosque with the name of a particular individual or group. Therefore, it is permissible to give the name of the Mosque in accordance with the name of the person who made the decree.
