Prohibition of Cutting Nails and Hair Applies To Shahibul Qurban Families?


Shahibul Qurban Family is Prohibited from Cutting Nails and Hair?
Afwan sir, if Qurban is intended for one family, are all family members not allowed to cut nails and hair?

Allah’s Commandment on Qurban

The command for this sacrifice has been revealed by Allah in the Quran. Qurban in Islam is essentially a form of devotion and resignation of his devoted servant in carrying out Allah’s commands. Below here is Allah Almighty says in Holy Book of Quran. 


إِنَّا أَعْطَيْنَاكَ الْكَوْثَرَ, فَصَلِّ لِرَبِّكَ وَانْحَرْ


“Indeed, We have granted you, [O Muhammad], al-Kawthar. So pray to your Lord and sacrifice [to Him alone].“



As from the time of entering the month of Dhu al-Hijah, people who would perform sacrifice cannot cut hair and nails, until the sacrificial animal slaughtering procession is carried out. The basis is the following prohibition of the Prophet sallallaahu 'alayhi wa sallam,

إِذَا رَأَيْتُمْ هِلاَلَ ذِى الْحِجَّةِ وَأَرَادَ أَحَدُكُمْ أَنْ يُضَحِّىَ فَلْيُمْسِكْ عَنْ شَعْرِهِ وَأَظْفَارِهِ

"If you have seen the moon of Dhulhijah (that is, have entered a Dhulhijah, writter) and you want to make sacrifices, then shohibul qurban let (meaning not cut) the hair and nails. 
(HR Bukhari)

There are quite strong of opinion among the scholars regarding the law of this prohibition.

Imam Ahmad and Ishaq view the prohibition on the hadith above its meaning as haram.

While in the Shafi'i mazhab, the prohibition on the hadith above means haram. This is what is considered strong by the Saudi Arabia fatwa commission 
(Lajnah Da-imah).

Hair that is forbidden to cut includes hair that is mubah and mustahab. Mubah hair means all the hair in our body, which there is not recommendation to shave it. The mustahab hair mean, the hair that is recommended to be shaved, like mustache, and pulling underarm hair.

Then, the sacrifice (Qurban) is a type of worship that we can intend to be likened togerther, such as Qurban with our own intentions for the family, or friends or others. As the Prophet sallallaahu'alaihi wa sallam once did when he slaughtered (Qurban) his sacrificial animal, He prayed,


اللّهُمّ هَذَا عَنِّي، وَعَمَّنْ لَـمْ يُضَحِّ مِنْ أُمَّتِي



"O Allah, this is my sacrifice and of my people who do not sacrifice."

(HR. Abu Daud, no. 2810 and Al-Hakim 4: 229 and dishonored Shaykh Al-Albani in Al Irwa ' 4: 349).

In the hadith of the sahaba (companion) Abu Ayyub the radihiyallahu'anhu stated,

كَانَ الرَّجُلُ يُضَحِّي بِالشَّاةِ عَنْهُ وَعَنْ أَهْلِ بَيْتِهِ


"At the time of the Prophet sallallaahu 'alaihi wa sallam someone (husband) slaughtered a goat as a sacrifice (Qurban) for himself and his family. "

(Narrated by Tirmidhi, he judged saheeh, Minhaajul Muslim, pp. 264 and 266).

But then the question arises, does the ban on cutting nails and hair also apply to people included in our sacrificial (Qurban) intentions?

The answer is, the ban only applies to the people who do sacrifice, not to the family he intended.

This is based on the following Hadith,


مَنْ كَانَ لَهُ ذِبْحٌ يَذْبَحُهُ فَإِذَا أُهِلَّ هِلاَلُ ذِى الْحِجَّةِ فَلاَ يَأْخُذَنَّ مِنْ شَعْرِهِ وَلاَ مِنْ أَظْفَارِهِ شَيْئًا حَتَّى يُضَحِّىَ


"Anyone who wants to sacrifice and if he has entered the beginning of Dhu al-Hijah (1 Dhu al-Hijjah), then do not cut his hair and nails until he sacrifices." (Narrated by Muslim).

In the above hadith, the Prophet sallallaahu'alayhi wa sallam linked the prohibition of cutting nails and hair with the people who do sacrifice only. That is, the person who has the cost of buying a sacrifice or sacrificing a pet sacrifice animal.

In Fatawa Lajnah Da-imah explained,

فتبين بهذا : أن هذا الحديث خاص بمن أراد أن يضحي فقط ، أما المضحى عنه فسواء كان كبيراً أو صغيراً فلا مانع من أن يأخذ من شعره أو بشرته أو أظفاره بناء على الأصل وهو الجواز ، ولا نعلم دليلاً يدل على خلاف الأصل



From the above hadith it is clear that this hadith is specifically related to people who want to sacrifice. As for those who are included in sacrificial intentions, both adult and child, there is no prohibition on cutting their hair or nails. This is based on the law the origin of cutting hair and nails is a mubah. And we do not find the argument that covers this original law.
