Can disbeliever or non-muslim Enter the Mosque?

Question:

Peace be upon you, and Allah's mercy and blessings.

Is it legal for Christians or people other than Muslims to enter the mosque?

Answer:


Wa'alaikumussalam warahmatullahi wabarakatuh

Bismillah was shalatu was salam 'ala rasulillah, amma ba'du,

Ulama disagree about the law of disbeliever or non-muslim entering the mosque. The following include:


First , infidels cannot enter mosques, both mosques in Haram land (Mecca) and mosques outside Haram land. This is the opinion of Imam Ahmad in one of his narrations.


It's just that, some of the Ulama's scholars allow if there are problems for the interests of the mosque, such as repairing buildings or the like.

Al-Buhuti - hambali Islamic scholars - said,

لا يجوز لكافر دخول مسجد الحل ولو بإذن مسلم; لقوله تعالى: إنما يعمر مساجد الله من آمن بالله واليوم الآخر سورة التوبة, ويجوز دخولها -أي مساجد الحل- للذمي, ومثله المعاهد والمستأمن إذا استؤجر لعمارتها; لأنه لمصلحته

It is not permissible for unbelievers to enter mosques even if they are in addition to Haram land, even with Muslim permission. Based on the word of God, which means, " The mosques of Allah are only to be maintained by those who believe in Allah and the Last Day and establish prayer and give zakah and do not fear except Allah, for it is expected that those will be of the [rightly] guided. " (Surah At-Tawbah: 18). Those who may enter the mosque are zimmi disbeliever, including mu'ahid and musta'min, when they are employed to repair mosques, because this is for the benefit of the mosque ( Kasyful Qana ' , 6: 265).

Among the arguments of those who took this opinion is the history that Ali ibn Abi Talib radhiyallahu 'anhu had seen anyone majusi in the mosque when he was preaching on the pulpit. Then Ali went down, and hit him and told him to come out. This opinion is also the opinion of Umar bin Khatab radhiyallahu 'anhu . Because if Muslims who Junub are not allowed to enter the mosque, the disbelievers are more suitable forbidden to enter the mosque
( Mathalib Uli an-Nuha , 2/617).



Secondly , infidels may enter the mosque, if it is expected he can enter Islam by seeing the activities of the Muslims in the mosque or hearing lectures. 


This is the opinion of al-Qodhi Abu Ya'la - the hambali cleric -. On condition, get permission from one of the Muslims. His statement was quoted in Mathalib Ilin Nuha ,

يجوز لكافر دخول المسجد بإذن مسلم إن رجي منه إسلام لأنه -صلى الله عليه وسلم- قدم عليه وفد أهل الطائف ، فأنزلهم في المسجد قبل إسلامهم

It is possible for infidels, disbeliever or non-muslim to enter the mosque with permission from a Muslim, if he is expected to convert to Islam. Because the Prophet sallallaahu 'alaihi wa sallam had been a guest from Taif, and he told them to stop in the mosque, and they had not yet converted to Islam ( Mathalib Uli an-Nuha , 2: 617).



Third , the prohibition of entering mosques for infidels, disbeliever or non-muslim, only applies to the Masjidil Haram and not other mosques. 


This is the opinion of Imam Ashafi, Ibn Hazm, al-Albani, Ibn Uthaymeen and several other scholars.

Among the arguments that confirm this opinion,

1. God's Word,

يَا أَيُّهَا الَّذِينَ آمَنُواْ إِنَّمَا الْمُشْرِكُونَ نَجَسٌ فَلاَ يَقْرَبُواْ الْمَسْجِدَ الْحَرَامَ بَعْدَ عَامِهِمْ هَذَا

" O you who have believed, indeed the polytheists are unclean, so let them not approach al-Masjid al-Haram after this, their [final] year. And if you fear privation, Allah will enrich you from His bounty if He wills. Indeed, Allah is Knowing and Wise. (year 9 H) . "

Al-Qurthubi quoted the statement of Imam Ashafi who said,

في سائر المشركين خاصة في المسجد الحرام, ولا يمنعون من دخول غيره فأباح دخول اليهود والنصارى في سائر المساجد

This verse covers the general of all polytheists, especially when entering the Masjidil Haram. And they are not prohibited from entering other mosques. Therefore, he allowed Jews or Christians to enter other mosques ( Tafsir al-Qurthubi , 8: 105).

The same information was also conveyed by Ibn Hazm, in al-Muhalla he said,

فخص الله المسجد الحرام ، فلا يجوز تعديه إلى غيره بغير نص

Allah specifies the law for the Masjidil Haram, because it should not be applied to other mosques without arguments ( al-Muhalla , 3: 162).

2. Practice the Prophet sallallaahu 'alaihi wa sallam

Among them, the statement of Abu Hurairah radhiyallahu 'anhu ,

بعث النبي صلى الله عليه وسلم خيلا قبل نجد, فجاءت برجل من بني حنيفة يقال له: ثمامة بن أثال, سيد أهل اليمامة, فربطوه بسارية من سواري المسجد, فخرج إليه النبي صلى الله عليه وسلم فقال: «أطلقوا ثمامة», فانطلق إلى نخل قريب مِنَ المَسْجِدِ ، فَاغْتَسَلَ ، ثُمَّ دَخَلَ المَسْجِدَ ، فَقَالَ: أَشْهَدُ أَنْ لاَ إِلَهَ إِلَّا اللَّهُ وَأَنَّ مُحَمَّدًا رَسُولُ اللَّهِ

The Prophet sallallaahu 'alaihi wa sallam once sent some horsemen to Nejd, suddenly the messenger returned with a prisoner named Tsumamah bin Utsal, the tribal leader of the Yamamah region. They bind it to one of the walls of the Prophet's Mosque. Then the Prophet sallallaahu 'alaihi wa sallam approached Tsumamah, then he ordered, "Let Tsumamah go." Then Tsumamah went to the palm garden near the mosque, he took a bath and entered the mosque, and declared Islam by shahada. Laa ilaaha illallaah muhammadur Rasulullah . (Narrated by Bukhari 2422 and Muslim 1764).


God willing Insha Allah, this is a stronger opinion, based on the practice of the meaning of the verse text and the practice of the Prophet sallallaahu 'alaihi wa sallam. Al-Khatib Asy-Syarbini said,

وثبت أنه - صلى الله عليه وسلم - أدخل الكفار مسجده, وكان ذلك بعد نزول "براءة", فإنها نزلت سنة تسع, وقدم الوفد عليه سنة عشر وفيهم وفد نصارى نجران, وهم أول من ضرب عليهم الجزية فأنزلهم مسجده وناظرهم في أمر المسيح وغيره

There is a saheeh history, that he sallallaahu 'alaihi wa sallam included infidels in his mosque, and that happened after the descent of surah At-Tawbah, this surah was sent down in the year 9 of the hijri. While he received many guests in the year 10 hijriyah, and among them there were Christians Najran. And they were the first tribe to be affected by jizyah obligations. The Prophet sallallaahu 'alaihi wa sallam told them to stop in the mosque, and he also argued with them about the Messiah and others. ( Mughni al-Muhtaj , 6:68).
